This Privacy Policy explains how we process the personal data you provide to us on the website (https://pro.freestyle.abbott/uk-en/) controlled by Abbott Laboratories Limited, Abbott House, Vanwall Business Park, Maidenhead, Berkshire SL6 4XE, (“Abbott”) containing a link to this Policy (together, the "Abbott Site") and by telephone.

Abbott processes your personal data in accordance with the principles of personal data protection, in particular the UK Data Protection Act 2018 and applicable local Data Protection legislation relating to data processing, files and freedoms as amended, together referred to as "the Regulation".

This Privacy Policy does not apply to personal data requested from you offline, on Abbott Sites that do not contain a link to this Privacy Policy, or to third-party websites to which the Abbott Site may direct you. Your use of the Abbott Site, which contains a link to this Privacy Policy, is subject to this Policy and the Terms of Use.

I. TYPES OF DATA COLLECTED

What does this Privacy and Cookie Policy mean by "personal data"?

"Personal data" is any information relating to an identified or identifiable natural person; 'identifiable natural person' means a natural person who can be identified, directly or indirectly, in particular by reference to an identifier, such as a name, an identification number, location data, an online identifier, or to one or more factors specific to his or her physical, physiological, genetic, mental, economic, cultural or social identity, and that are communicated and/or collected on the Abbott Site and maintained by Abbott in an accessible form.

Personal data includes, for example, your name, postal address, e-mail and telephone number.

What types of data is Collected Online by Abbott?

•               Personal Data You Provide: Abbott collects personal data that you enter in the fields on the Abbott Site or that you provide to Abbott by telephone. For example, you may provide your name, mailing address, email, telephone numbers, and/or other data in order to receive information on various topics, enroll in Abbott programs, create an account, contact Abbott customer service, or respond to Abbott surveys. You may also provide Abbott with information about your health (see below II. Collection of Personal Information"). To protect the privacy of your data, do not provide Abbott with any information that is not specifically requested.

•               Passive collection of other technical and Internet browsing data: The Abbott Site may collect information about your visits to the Abbott Site without you actively communicating such information. This information may include, for example, the type of browser software you use and its language, your operating system, your IP address, the URLs of the sites you visit before and after your visit to the Abbott Site, the Internet search that led you to the Abbott Site, the pages and advertisements you view, and the links you click on the Abbott Site. This information may be collected through different technological means such as cookies, HTML tags and pixel tags. Your browser software also automatically transmits to the Abbott Site certain information such as the URL of the site you have just visited and the version of the browser software used by your computer.

II. COLLECTION OF PERSONAL DATA

Does Abbott collect so-called "sensitive" personal data?

Through certain Abbott Sites, Abbott collects personal data, including health-related personal data, that may be considered "sensitive" under data privacy laws in certain jurisdictions, but only with your consent. You have the right to withdraw your consent at any time. However, the withdrawal of consent does not affect the lawfulness of the processing based before its withdrawal.

Abbott adopts the additional measures provided by local law for the processing of this information. In addition, each Abbott subsidiary or affiliate must take steps to respect local customs or social expectations regarding such information. When you provide us with confidential personal data, you agree that Abbott may collect, transmit it to identified recipients or categories of recipients, store it and process it.

How does Abbott use the personal data I have provided?

Abbott uses the personal data you provide to Abbott through the Abbott Site or by telephone to answer your questions, provide products or services associated with them, including useful reminders when Abbott deems it necessary for you to renew your order and provide you with satisfactory customer service, including through surveys.

We may also use this personal data for other business purposes, such as offering you information about Abbott products or services, inviting you to participate in events about our products, or notifying you of special promotions.

The transmission of personal data to Abbott is necessary in order for Abbott to provide you with a product or service that you have requested or to comply with European or local laws, such as those relating to the safety of products or medical devices. If you do not provide us with this personal data, Abbott will not be able to provide you with the product or service you have requested.

How long is my personal data retained by Abbott?

Your personal data will be retained for as long as necessary to provide you with the application, service or product you have requested, or, if applicable, for the duration of your contract with Abbott.

In addition, in the data collected and processed for commercial purposes are kept three years after our last contact with you.

Beyond that, the data is archived for the time required by the legal and regulatory provisions that may apply to the retention of certain data.

At the end of the archiving, only anonymized statistical data is kept by Abbott.

In addition, your personal health-related data is hosted by an approved/certified health data host. As such, you have the right to object to the hosting of your health data with this third-party host for a legitimate reason by making a request to the following address: https://www.abbott.com/eudpoform.html. However, please note that your objection to hosting your health data may deprive you of certain services and features of the products and services offered by Abbott.

To what extent can I choose how Abbott collects and uses my personal data?

You may restrict the amount and type of personal data Abbott receives about you by choosing not to provide any personal information in the forms or fields to be filled in on the Abbott Site. Some of our online services can only be provided if you provide us with correct personal data. Other areas of the Abbott Site may ask you whether or not you wish to be part of our contact list for offers, promotions and other services that may be of interest to you.

Who are the recipients of your personal data?

On a case-by-case basis for the various purposes described in the section "How does Abbott use the personal data I have provided?" above, the recipients of your personal data are determined according to their missions and their strict authorizations to receive data.

Depending on the case, these recipients can be:

•               Employees of Abbott and its subsidiaries, specifically authorized and in strict compliance with their duties;

•               Members of subcontractors and technical service providers specifically authorized and in strict compliance with their missions;

•               Staff members of Abbott's business partners, subject to your consent;

•               Persons entitled under authorized third parties (relevant courts, arbitrators, mediators, relevant ministries).

Who within Abbott can access my personal data?

Only a limited number of specifically authorized Abbott employees can access your personal data. We train our employees on the importance of privacy and how to properly and securely handle and manage customer data.

Linking to other websites?

Abbott's site may contain links to other websites. However, once you have used these links to leave our site, you should note that we have no control over that other site. Therefore, we cannot be responsible for the protection and privacy of the information you provide while visiting these sites and these sites are not governed by this privacy statement. You should exercise caution and be aware of the confidentiality of the data applicable to the site in question.

How secure does Abbott provide for personal data?

Abbott implements appropriate technical and organizational measures taking into account the state of knowledge, scope, costs, context, nature and purposes of the processing to ensure a level of security appropriate to the risks.

However, there is always a risk that an unauthorized third party could intercept a transmission over the Internet. Please exercise caution when transmitting personal data over the Internet, including personal health-related data. In addition, the Abbott Site covered by this Privacy Policy will display an alert each time you click on a link that is not controlled by Abbott or subject to Abbott's Privacy Policy; it is recommended to check the privacy policies of these third-party sites before providing them with personal data.

Is personal data transferred by Abbott to other jurisdictions?

Abbott stores data on secure servers located in several countries across the European Union (EU) as well as on the secure server of a service provider established in Ireland certified, Amazon Ireland, which thus ensures a sufficient level of protection for data transfers from the European Union.

In addition, and in cases where we may need to transfer your personal data outside the European Economic Area ("EEA") to third parties who do not offer the same level of protection as that imposed by the EU, in order to protect your personal data, we will only make such transfers (i) on the basis of a decision of the European Commission that authorises it or (ii) subject to Eu-approved Standard Contractual Clauses.

Please note that Abbott has entered into data transfer agreements based on EU Standard Contractual Clauses for the transfer of your personal data from the EEA to third countries, including the United States of America. What privacy protection does Abbott provide to minors?

Abbott does not knowingly collect or use the personal data of minors ("minor" being understood as a minor under the age of 18) on the Abbott Site. We do not knowingly let minors order our products, communicate with us or use our services.

If you are a parent and become aware that your minor child has provided us with information, please contact us by one of the means listed below and we will do our utmost to resolve this issue together.

What are my rights in relation to personal data collected by Abbott?

In accordance with the Regulations, you have the following rights:

•               The right to rectification or erasure of any erroneous or incomplete personal data that Abbott holds about you;

•               The right to object at any time to any direct marketing activity on our part. This will appear at the bottom of any email we send you;

•               The right to access Abbott's personal data about you;

•               The right, in certain cases, to object to the processing of your personal data for legitimate reasons;

•               The right not to be subject to a decision based on automated processing in order to evaluate certain personal aspects of your life, including behaviour-based analyses. Please refer to the "Cookies" section of the Privacy Policy to learn more about how to exercise this right if it is specified that cookies are used.

•               Where you have provided your personal data to us with your consent or as part of a contract, the right to the portability of that personal data to another person or, if it’s technically feasible for us to do so, to another company;

•               The right to lodge a complaint with your national data protection supervisory authority or to receive compensation for any damage you suffer; and

How do I know that Abbott has updated this Policy?

Without prejudice to your rights under applicable law, Abbott reserves the right to modify this Privacy Policy without notice to reflect technological advances, legal and regulatory developments and good business practices.

If Abbott changes its privacy practices, an updated version of this Privacy Policy will reflect those changes and we will notify you of those changes by updating the effective date at the top of this Privacy Policy.

IV. FOR PERSONS LOCATED WITHIN THE EEA

The EU's General Data Protection Regulation ("GDPR") amends and updates your rights over your personal data and defines what companies that process your personal data are allowed to do and what is imposed on them as such. It also requires that we provide you with the following information in addition to that which has already been transmitted to you. This additional statement supersedes all incompatible information that has already been provided to you.
